Adaptive QOS doesn't appear to work, suggestions?

I have one other problems with this gents. QOS and VPN. It appears with VPN on and QOS on it defaults to my upload speed so my bandwidth is extremely limited. Thoughts? With either enabled separately I get full bandwidth no problem so it isn't a hardware limitation, they just don't work together. Am I SOL and have to choose one or the other? I'm also fixing to upgrade to 300/20, if I'm SOL maybe just turn QOS off and go with hardware acceleration?

fresj jr script can be modded with the vpns port, so it gets classfied as orthers, web surfing ,etc you just have to pick one.
