Reason hes not publishing source is perfectly valid (and being a private build) .. even though it does sort of kick in the pants the spirit of GPL.. Its called liability.. you may not like it, or not be comfortable but he still could hold liable if he "gives keys to the kingdom"... Its your choice to install or not install.. In theroy I could do this semi-legally under hamradio power regulations..and we could go that tack of limiting it to amateur radio operators... but then interference would also come into play and layfolks could not use my connection

With all due respect, I find that sentiment to be utterly nonsensical. You say he's offering a "private build"? I don't think that is consistent with the history of what he's done: First, he made his FW available the general public via links that were formerly available here at SNB; then, when asked repeatedly to share his code, and after making excuse after excuse about why he was "too busy" to do so, he resorted to his latest tactic at distribution, having those who PM him provided with a link to a MediaFire directory from which he distributes this firmware. It's not "private" though, and the genie is out of the bottle on that sort of an argument. He has already exposed himself to liability.
